Kinver Neighbourhood development plan 

Decision Statement published pursuant to the Localism Act 2011 Schedule 38A (9) and Regulations 19 and 20 of the Neighbourhood Planning (General) Regulations 2012

South Staffordshire Council decided by resolution of Cabinet Member for Business Enterprise and Community Infrastructure on 20th September 2023 to make the Kinver Neighbourhood Development Plan under Section 38A(4) of the Planning and Compulsory Purchase Act 2004 (as amended). The Kinver Neighbourhood Development Plan now forms part of the Development Plan for South Staffordshire.

Reasons for Decision

The Kinver Neighbourhood Plan meets the statutory Basic Conditions, and the process of its development is compliant with legal and procedural requirements. Paragraph 38A(4)(a) of the Planning and Compulsory Act 2004 requires the Council to make the Neighbourhood Plan if more than half of those voting in a public referendum have voted in favour of the Plan being used to help decide planning applications in the area. The plan was endorsed by more than the required threshold in the referendum of 24 August 2023.

Regulation 16 Consultation

Kinver Parish Council submitted its draft Neighbourhood Development Plan to the council, and we carried out consultation on it under Regulation 16 of the Neighbourhood Planning (General) Regulations 2012.  The consultation is now closed.

The the 6-week consultation period ran from Monday 23 January until 5pm Monday 6 March 2023.

It is the responsibility of South Staffordshire Council to collate all the representations and pass them on to an independent examiner, who will look at them and the plan documents when assessing whether the plan meets the legislation and can proceed to the next stage which is referendum.

The Regulation 16 consultation on the Kinver Neighbourhood Plan closed on 6th March 2023, and all representations received have been sent to the appointed examiner, Wendy Burden.

As noted in the Examiner Procedural Matters letter the examination process has now started.

The Examiner has now issued Questions of Clarification which require a response by Tuesday, May 9th, 2023.

Kinver Neighbourhood Plan Referendum

Notice of Referendum

Notice of Poll for Kinver Neighbourhood Plan Area (Polling Station Locations)

South Staffordshire Council decided on 13 July 2023 that the Examiner’s recommended modifications should be made to the Plan, and that the Plan as amended should proceed to a referendum. A referendum to consider the modified plan is to be held on Thursday,  August  24, 2023. The specified documents to inform the referendum decision are below.

The specified documents include the Decision Statement, detailing the changes to be made to the Plan and the decision to proceed to referendum, as well as the updated ‘Referendum Version’ of the Kinver Neighbourhood Plan along with a summary of the representations received during the Regulation 16 consultation period and a General Information Document. The General Information Document includes advice on the planning system including the role of Neighbourhood Plans and details of the referendum.
