(Civil Enforcement of Parking) (Off-Street Parking Places) (Amendment No.1) Order 2024
Operative from 1 May 2024
1. This Order is made by South Staffordshire District Council (“the Council”) in exercise of their powers under Sections 32, 35 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 as amended (the “1984 Act”) and of all other enabling powers. The Council makes this Order with the consent of Staffordshire County Council in accordance with Section 39(3) of the 1984 Act and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the 1984 Act.
2. This Order shall come into operation for all purposes on 1 May 2024 and may be cited as South Staffordshire District Council (Civil Enforcement of Parking) (Off-Street Parking Places) (Amendment No.1) Order 2024.
3. The South Staffordshire District Council (Civil Enforcement of Parking) (Off Street Parking Places) Order 2010 (the “Original Order”) is amended as follows:
(1) The definition of “Pay and Display Ticket” is deleted and replaced as follows:
“Pay and Display Ticket”, “Parking Ticket”, “Ticket” or “Tickets” means the ticket or tickets issued or obtained from a ticket machine or from the Ranger’s office located in the parking place in which the vehicle has been parked or issued by a person nominated by the Council, or via a mobile telephone through the pay by phone scheme on payment of a charge and valid for a parking period as advertised at that parking place;
(2) The definition of “bicycle” is deleted and replaced as follows:
“pedal cycle” means a non-assisted or electrically-assisted vehicle normally with two wheels (but up to four) attached to a frame, to include, but not exclusively, a tricycle;
(3) The definition of “valid parking ticket” is deleted and replaced as follows:
“valid parking ticket” means a ticket purchased for that parking place by either the insertion of the accepted method of payment into an apparatus or device having been specifically or generally approved by the Secretary of State for Transport for such purpose; by making payment to a person duly authorised by the Council at the Ranger’s office; or via the pay by phone scheme;
(4) The following definitions are added to clause 2 of Part I:
“accepted method of payment” means payment in the manner as described on the signs or ticket machine adjacent to the relevant parking place;
“coach” means a large passenger carrying vehicle;
“electric vehicle” means a vehicle that is propelled by one or more electric motors powered by a rechargeable battery;
“hybrid vehicle” means a vehicle that is propelled by one or more electric motors powered by a rechargeable battery in combination with a petrol or diesel engine;
“minibus” means a small passenger carrying vehicle seating no more than 16 passengers;
“pay by phone scheme” means a scheme which enables a driver to pay the specified charge for parking via a mobile telephone in the manner as described on the signs or ticket machine adjacent to the relevant parking place;
“Ranger’s office” means the office of a person duly authorised by the Council within the car parks at Baggeridge Country Park, Visitor Centre, Nr Himley (Plan Reference 11) and the car park and coach park at Brick Kiln Way, Baggeridge Village, Sedgley, DY3 4BB (Plan References 20 and 21)
“virtual parking permit” means a non-physical season ticket, contract permit, business permit, staff permit or resident’s permit of a type and design issued by the Council;
“Virtual Ticket” means a non-physical ticket issued virtually upon payment of the specified charge for parking by a driver using a pay by phone scheme.
(5) A clause 8(e) is added to Part II Designation and Use of Parking Places:
“no person shall cause or permit a vehicle to be parked in a parking place marked for charging of electric vehicles unless it is an electric vehicle or a hybrid vehicle charging and the owner has paid for parking.”
(6) Clause 12 is deleted and replaced as follows:
The expiry of the period for which the charge has been paid shall be when the time shown on the clock of the issuing ticket machine or time shown on the pay by phone scheme is later than the time exhibited on the valid parking ticket.
(7) Clause 13 is deleted and replaced as follows:
If at any time a vehicle is left in a parking place no valid parking ticket is displayed on the vehicle, nor is a Virtual Ticket or virtual parking permit available to view by a person duly authorised by the Council, it shall be judged that the charge has not been paid.
(8) Clause 36 of Part III Charges for Parking is deleted and replaced as follows:
The person in charge of a vehicle, upon parking the vehicle in a parking bay, shall immediately display a parking permit; ensure a virtual parking permit is available to view; or arrange for the purchase of a Ticket from a ticket machine, or from the Ranger’s office, situated at that parking place or for the purchase of a Virtual Ticket by using a pay by phone scheme, in accordance with the information displayed at a ticket machine, at the level of charge and for the period required in accordance with the specified charges as advertised at that parking place.
(9) Clause 37 of Part III Charges for Parking is deleted and replaced as follows:
Once a vehicle has been parked within a pay and display parking place the person in charge of the vehicle shall ensure that:
(i) a valid parking permit, virtual parking permit or valid Pay and Display Ticket has been obtained to cover the entire period that the vehicle is parked in the parking place; and
(ii) where issued from a ticket machine, the valid Pay and Display Ticket is displayed in the relevant position on the vehicle, in respect of which it was issued, at all times the vehicle is parked; or
(iii) where a Virtual Ticket is issued by using a pay by phone scheme, proof of purchase of a valid Virtual Ticket in respect of the vehicle of which it was issued shall be available to view upon request by a person duly authorised by the Council at all times the vehicle is parked.
(10) Clause 39 of Part III Charges for Parking is deleted and replaced as follows:
A Pay and Display Ticket is valid only in the parking place in which it was issued. Where a Ticket is issued from a ticket machine, this is defined by the reference code of the ticket machine located in that parking place printed on the Pay and Display Ticket. Where a Virtual Ticket is issued by using a pay by phone scheme, this is defined by the scheme reference code displayed in the parking place.
(11) Clause 40 of Part III Charges for Parking is deleted and replaced as follows:
The expiry of the period for which the appropriate charge has been paid shall be:
-
where a Pay and Display Ticket has been purchased, when the time shown on the clock of the issuing ticket machine is later than the expiry time shown on the Ticket; or
-
where a Virtual Ticket has been purchased by using a pay by phone scheme, the time of expiry as displayed by the pay by phone scheme; or
-
where a parking permit or virtual parking permit has been purchased, the date on which the parking permit expires.
(12) Clause 41 of Part III Charges for Parking is deleted and replaced as follows:
If at any time while a vehicle is parked in a parking place no Ticket or parking permit is displayed on that vehicle in the relevant position, nor is a Virtual Ticket or virtual parking permit available to view by a person duly authorised by the Council and in accordance with the provisions of this Order, it shall be deemed that the charge has not been paid.
(13) Clause 42 of Part III Charges for Parking is deleted and replaced as follows:
If at the time when a vehicle is parked during the charging hours in a parking place and the nearest ticket machine in that parking place is out of order, then a ticket shall be obtained from another ticket machine within the same parking place (where provided), via a pay by phone scheme or as directed in the parking place.
(14) Clause 43 of Part III Charges for Parking is deleted and replaced as follows:
Where no valid Pay and Display Ticket can be obtained from a ticket machine or from the Ranger’s office, within a parking place, vehicles may be parked in a parking place but may not be parked for longer than the maximum period of parking in that parking place as advertised at the parking place.
(15) Clause 46 of Part IV Exemptions is deleted and replaced as follows:
If, at the time when a vehicle is parked in a parking place during the charging hours: there is no ticket machine at the parking place; all the ticket machines at that parking place carry notices placed upon them by a person duly authorised by the Council indicating that they are out of order; or it is not possible to purchase a Ticket from the Ranger’s office, the driver of that vehicle shall be exempt from purchasing a Pay and Display Ticket.
(16) The parking place of Council Offices, Wolverhampton Road, Codsall is deleted and replaced as follows within the table contained within the Schedule of the Original Order:

(20) Plan Reference 8 to the Schedule of the Original Order is deleted and replaced with a new Plan Reference 8.
(21) Plan Reference 14 is deleted.
(22) Plan References 20 and 21 are added.
4. Save for the amendments to the Original Order as set out above, the remaining provisions of the Original Order shall continue in force.
